MACT/GACT, NSPS, and NCAC Regulatory Guide for Insignificant / Permit Exempt Activities

40 CFR 63, Maximum Achievable Control Technology (MACT)
40 CFR 63, Generally Available Control Technology (GACT)
40 CFR 60, New Source Performance Standards (NSPS)
Title 15A, North Carolina Administrative Code (NCAC)

The following table is to provide a regulatory guide for those non-Title V facilities that are operating an air emission source(s) that is subject to a federal and/or state rule(s), but is exempted from permitting requirements, and is listed on the "Insignificant / Exempt Activities" table attached to the air permit. This table may also be used by Title V facilities that are operating an air emission source that is listed on the "Insignificant Activities" list attached to the air permit. This guide is to assist the facility in understanding their compliance obligations with respect to emission limitations or standards, and compliance monitoring, record keeping, and reporting requirements.

NOTE: These regulatory guides do not necessarily address all applicable requirements. Compliance with an applicable federal and/or state rule is the responsibility of the facility.
